Former "Rich Kids of Beverly Hills" contestant Brendan Fitzpatrick has found himself in legal trouble. The Palm Beach-based realtor, who rose to fame through his work with Mauricio Umansky's firm, The Agency, is accused of defrauding investors of more than $80 million.
Brendan Fitzpatrick, a former contestant on the reality show "Rich Kids of Beverly Hills," is facing charges of embezzling more than $80 million.
During his time on the E! series "Rich Kids of Beverly Hills," Brendan seemed to be living the high life. He was even briefly married to Morgan Stewart, his co-star. However, the realtor is now accused of involvement in an alleged sham development and Ponzi scheme.
The New York Post reported that Brendan was allegedly being sued by alleged victims who claim his company, Carbonatik LLC, never existed. Furthermore, this purported Sri Lankan mining company allegedly promised investors a whopping $1,201,000 return on investment. The company was founded in 2022 by Brendan and his partner, Dr. Joseph Swaminathan. Carbonatik LLC allegedly owned reserves of graphite, rare earth minerals, and copper in Sri Lanka.
Investors in this venture reportedly include entrepreneurs and Brendan's acquaintances, who allegedly contributed hundreds of thousands of dollars. In November 2025, investors Richard Segerson and Dave Smith sued Carbonatik for their $500,000 investment. They are awaiting trial. Meanwhile, Carbonatik has appointed a receiver, denies the allegations, and filed a counterclaim. These counterclaims include defamation.
Neither Brendan nor Joseph Swaminathan responded to the New York Post's request for comment.
Brendan also faces another lawsuit filed in the London Commercial Court by four Belgian investors. The suit against Varko Luxco HoldCo S.à rl and Carbonatik concerns the construction of the Varko Bay hotel in Greece. The plaintiffs claim to have sold their stakes in companies associated with the project. However, they claim they have not been fully paid under the agreement and are seeking damages of approximately $70 million.
